These Terms & Conditions govern bookings made with Up Albania sh.p.k., a fully licensed tour operator based in Tirana, Albania.
Please read them carefully before confirming your booking. By asking us to confirm a booking and paying the required deposit or full payment, you confirm that you have had the opportunity to read and accept these Terms & Conditions.
In these conditions, “you”, “your”, “traveller” and “client” refer to all persons named on a booking, including anyone subsequently added or substituted. “we”, “us”, “our” and “Up Albania” refer to Up Albania sh.p.k.
These conditions apply to travel arrangements booked directly with us or through a travel agent or other authorised partner selling trips operated or arranged by Up Albania.
The specific services included in your booking are those stated in your confirmed itinerary, booking confirmation or invoice.
1. Prices & Reservations
Unless otherwise stated, our prices are quoted in EUR.
All itineraries and services are subject to availability until your booking has been confirmed.
Your confirmed itinerary or tour page will specify the services included in your trip.
Unless specifically stated otherwise, prices do not include personal expenses, gratuities, passport or visa costs, travel insurance, vaccinations or medical expenses, optional activities, meals and drinks not specified in the itinerary, or other services not expressly listed as included.
Prices include applicable taxes and charges imposed on the services included in the package, unless otherwise stated.
We reserve the right to correct pricing or typographical errors before a booking is confirmed. If we identify an error, we will inform you of the correct price before confirming your booking.
2. Booking & Payments
A 20% deposit is required to confirm your booking.
The remaining 80% balance is due 45 days before departure.
For trips of 3 days or less, the remaining balance is due 20 days before departure.
If a booking is made after the applicable final-payment deadline, full payment may be required at the time of booking.
We accept payment in EUR by the payment methods made available to you, which may include bank transfer, credit/debit card and cash where agreed.
Your booking is confirmed only when we have received the required payment and issued written confirmation.
An acknowledgement of an enquiry, availability check or online booking request does not by itself constitute confirmation.
For bookings submitted directly through our website without prior confirmation of availability, we reserve the right to decline or cancel the booking within 48 hours if the requested services are unavailable. Any payment received for a booking we are unable to confirm will be refunded as applicable.
Please check your booking confirmation, invoice and itinerary carefully and notify us promptly if any information is incorrect or incomplete.
If the balance is not received by the applicable due date, we reserve the right to treat the booking as cancelled by you, in which case the applicable cancellation conditions will apply.
3. Cancellation by You
All cancellations must be communicated to us in writing, normally by email, by the person who made the booking or the designated group/party leader.
Cancellation becomes effective on the date we receive your written notification.
Unless different cancellation conditions were expressly agreed for your booking, the following cancellation charges apply:
| Cancellation before departure | Cancellation charge |
|---|---|
| 70 days or more | No cancellation charge — 100% of deposit paid refunded |
| 45–69 days | 20% of total tour price |
| 30–44 days | 30% of total tour price |
| 15–29 days | 50% of total tour price |
| 8–14 days | 75% of total tour price |
| 7 days or less | 100% of total tour price — no refund |
These standard cancellation conditions apply to individual bookings and private groups of up to 8 travellers.
Larger groups, special events, tailor-made arrangements or bookings involving suppliers with stricter cancellation conditions may be subject to different terms. Where this applies, we will inform you before your booking is confirmed.
We strongly recommend comprehensive travel insurance that includes appropriate cancellation cover.
4. Postponements & Changes Requested by You
If you wish to postpone your trip rather than cancel it, you may normally do so without an Up Albania postponement fee when the request is received at least 45 days before departure.
Payments already made may be credited towards the rescheduled trip.
However, any non-refundable costs, price differences or amendment charges imposed by hotels, airlines, transport companies, activity providers or other third-party suppliers may still apply.
The new trip may also be subject to different prices due to changes in travel dates, accommodation rates, transport costs, exchange rates, group size or other services.
Requests to change names, dates, accommodation, activities, itinerary or other confirmed arrangements are subject to availability. We will make reasonable efforts to accommodate requested changes but cannot guarantee that every amendment will be possible.
5. Changes to Your Itinerary by Up Albania
Travel, particularly in the Balkans and in mountainous, rural or coastal areas, sometimes requires flexibility.
Up Albania reserves the right to make reasonable changes to a confirmed itinerary where necessary, including changes arising from circumstances beyond our control.
These may include, but are not limited to:
- adverse weather;
- unsafe sea, river, mountain or trail conditions;
- road closures or transport disruption;
- natural events;
- fires, floods or other environmental conditions;
- strikes or civil disruption;
- border restrictions or closures;
- government actions or regulations;
- closures of attractions, archaeological sites or facilities;
- safety or security concerns;
- changes imposed by hotels, transport operators or other suppliers;
- mechanical or operational problems;
- circumstances affecting the safe operation of an activity; or
- other events that could not reasonably have been avoided.
Necessary changes may include alterations to the route, order of visits, accommodation, transportation, activities, guides, departure times or other services forming part of the itinerary.
Where a change is necessary, we will make reasonable efforts to provide a suitable alternative and preserve the overall character, quality and content of the trip as far as reasonably possible.
A reasonable itinerary change made for operational or safety reasons does not in itself constitute cancellation of the trip.
6. Force Majeure & Circumstances Beyond Our Control
For the purposes of these Terms, circumstances beyond our reasonable control may include events that neither Up Albania nor the relevant supplier could reasonably prevent or avoid.
Examples may include severe weather, natural disasters, wildfire, flooding, epidemics or public-health emergencies, war or threat of war, civil unrest, terrorism or security incidents, government actions, border closures, strikes, transport disruption, major road closures and similar extraordinary events.
Where such circumstances affect your trip, our first priority will be to identify a safe and reasonable solution.
Depending on the circumstances, this may involve changing the itinerary, substituting services, delaying an activity or transfer, offering an alternative activity or, where necessary, cancelling part or all of the affected arrangements.
Up Albania will not be responsible for losses or expenses resulting solely from circumstances beyond our reasonable control to the extent permitted by applicable law.
If circumstances beyond our control create unavoidable additional costs during a trip — for example additional accommodation, meals or transport — we will inform you as soon as reasonably possible and explain any additional costs before arrangements are made wherever circumstances permit.
7. Cancellation or Significant Changes by Up Albania
We reserve the right to cancel or significantly modify a trip where it becomes impossible or unsafe to provide the confirmed arrangements, or where circumstances beyond our reasonable control require us to do so.
If we need to make a significant change before departure, we will inform you as soon as reasonably possible and explain the options available based on the circumstances and applicable law.
Where reasonably possible, we may offer an alternative arrangement of comparable character or standard.
Nothing in these Terms affects any refund, compensation or other rights that you may have under mandatory applicable law.
8. Travel Insurance
You are responsible for obtaining adequate and appropriate travel insurance for your trip.
Your insurance should be suitable for the destinations and activities included in your itinerary and should, where appropriate, cover:
- trip cancellation and interruption;
- medical treatment;
- emergency evacuation and repatriation;
- accidents and personal injury;
- baggage and personal belongings; and
- adventure or outdoor activities included in your trip.
You are responsible for ensuring that the insurance you purchase is appropriate for your individual circumstances.
9. Health, Fitness & Accessibility
You are responsible for ensuring that you are reasonably able to participate in the activities included in your chosen itinerary.
Some trips may include hiking, rafting, kayaking, cycling, ATV/quad activities, boating or other outdoor and adventure activities requiring an appropriate level of physical fitness.
The level of difficulty will vary between itineraries and activities.
If you have a medical condition, disability, mobility requirement, allergy or other circumstance that may affect your participation or require special arrangements, please inform us before booking or as soon as reasonably possible.
We will make reasonable efforts to advise you about the suitability of an itinerary and any arrangements that may be available.
You remain responsible for seeking appropriate medical advice where necessary.
10. Passports, Visas & Border Requirements
You are responsible for ensuring that you possess all passports, visas, permits and other documents required for the countries included in your itinerary.
Passport, visa, immigration and entry requirements vary according to nationality and destination and may change without notice.
This is particularly important for multi-country itineraries, where different entry requirements may apply in Albania, Montenegro, Kosovo, North Macedonia, Greece, Serbia, Italy or other countries visited.
Up Albania may provide general travel information, but you remain responsible for verifying the requirements applicable to your nationality and circumstances.
We are not responsible for costs or losses resulting from a traveller being refused entry, exit or transit because they do not possess the required documentation or comply with applicable entry requirements.
11. Traveller Responsibilities
You are expected to behave responsibly and respectfully towards other travellers, our guides and staff, local communities and our suppliers.
You must follow reasonable safety and operational instructions provided by Up Albania representatives, guides, drivers and activity providers.
You are also responsible for complying with applicable laws and regulations in the countries you visit.
We reserve the right, in serious circumstances, to terminate a traveller's participation in a trip where their behaviour presents a significant risk to themselves or others, seriously disrupts the trip, damages property, or involves unlawful or abusive behaviour.
Where participation is terminated for such reasons, we will not normally be responsible for additional accommodation, transport or other costs incurred by the traveller, subject always to applicable law.
12. Adventure Activities & Acknowledgement of Risk
Some Up Albania itineraries intentionally include travel to mountainous, rural, coastal or less-developed areas where infrastructure, medical services and operating conditions may differ from those in your home country.
Activities such as hiking, rafting, kayaking, boating, cycling, ATV/quad excursions and other outdoor activities involve inherent risks.
These may include changing weather conditions, uneven or difficult terrain, water conditions, falling rocks, road conditions, wildlife, physical exertion, accident, injury and delays in accessing medical assistance.
By choosing to participate in such activities, you acknowledge the inherent risks associated with them.
Up Albania and its suppliers take reasonable measures to manage safety, but it is not possible to eliminate every risk associated with travel and outdoor activities.
You must follow the safety instructions provided by guides, instructors and activity providers and inform them of any relevant circumstances that could affect your safe participation.
13. Accommodation & Other Suppliers
Up Albania works with independent hotels, guesthouses, transport companies, guides, restaurants, activity providers and other local suppliers.
Accommodation classifications and standards may differ between countries and destinations.
Where a specifically confirmed accommodation becomes unavailable, we may substitute another property of a reasonably comparable standard and location where possible.
Room types, bedding arrangements and special requests are subject to availability unless expressly confirmed by us.
We carefully select our partners, but many services included in your trip are ultimately performed by independent suppliers.
14. Self-Drive Tours
Where your itinerary includes a rental vehicle, the vehicle rental is also subject to the rental company's applicable rental conditions.
Travellers are responsible for satisfying applicable requirements relating to:
- valid driving licences;
- minimum or maximum driver age;
- authorised drivers;
- deposits or security authorisations;
- fuel policies;
- insurance and insurance excesses;
- traffic and parking regulations;
- fines, tolls and penalties; and
- proper use of the vehicle.
Specific vehicle inclusions, insurance arrangements and rental conditions will be provided with your booking or vehicle documentation.
You are responsible for driving safely and complying with local road laws and rental conditions.
Up Albania may arrange the rental as part of your itinerary but cannot accept responsibility for fines, traffic violations, negligent use of the vehicle or breaches of the rental agreement by the traveller.
15. Third-Party Suppliers
Up Albania may arrange services provided by independent third parties, including accommodation, transportation, guides, restaurants, ferries, boats and activity providers.
We take reasonable care when selecting and arranging these services.
However, third-party suppliers may have their own operating conditions, safety requirements and terms that apply to the services they provide.
Nothing in this section limits any responsibility that Up Albania is legally required to assume as tour operator under applicable law.
16. Limitation of Liability
Up Albania will exercise reasonable care in organising and providing the services included in your confirmed itinerary.
We are not responsible for losses arising from:
- your own acts or omissions;
- the acts or omissions of another traveller;
- circumstances beyond our reasonable control;
- services independently arranged by you and not included in your Up Albania booking; or
- your failure to follow reasonable instructions, legal requirements or supplier conditions.
To the extent permitted by law, we are not responsible for indirect or consequential losses that could not reasonably have been anticipated when the booking was made.
Nothing in these Terms & Conditions excludes or limits any liability or traveller rights that cannot legally be excluded or limited under applicable law.
17. Complaints
If you experience a problem during your trip, please inform your guide, trip designer or the relevant supplier as soon as possible.
This gives us an opportunity to investigate the issue and, where possible, resolve it while your trip is still taking place.
If the problem cannot be resolved locally, please contact Up Albania using the contact details provided with your travel documents.
If you remain dissatisfied after your trip, please submit your complaint to us in writing, preferably within 7 days after the end of your trip, including your booking reference and sufficient details for us to investigate the matter.
The request to contact us within seven days is intended to allow us to investigate promptly and does not affect any mandatory rights you may have under applicable law.
18. Photography, Video & Marketing
Photographs and video may be taken during our trips.
We may occasionally use travel photography or video in Up Albania's website, social media and promotional communications where permitted.
If you do not wish to appear in promotional photographs or video, please inform us or your guide.
If you voluntarily provide photographs, videos, testimonials or other material to Up Albania for promotional use, we may use that material in accordance with the permission provided.
More information about how personal information and promotional material are handled is available in our Privacy Policy.
